This complaint is based on a newspaper article regarding a judge’s decision. Based on the information in the article, the complainant, a lawyer, felt that the judge was unable to control his actions in court, portrayed misconduct, ordered punitive costs and ignored the guidelines for matrimonial assets. The complainant also mentioned that a self-represented litigant should be treated with a calm demeanour, alleging that the judge had been disrespectful.

The Council reminded the complainant that a judge will assess credibility through testimony and make findings about the evidence presented in court within the exercise of judicial discretion and this is not considered an issue of conduct. The complainant was advised that a judge takes the responsibility to ensure that a self-represented litigant is aware of their procedural options and understands their rights, but cannot act as an advisor to them. It was determined that there was no misconduct from the judge, the matter was closed.
