In a lengthy family law case, the complainant stated that the during the multiple hearings with the same judge, the judge failed to review court records, made numerous errors and presided over the hearings in an insufficient way.

The Council advised the complainant that the duties of a judge include the exercise of judicial discretion in deciding procedural issues and in controlling the proceedings. If the complainant is unhappy with the outcome of their trial, they have the right to appeal their case with the appropriate courts; however, it is outside of the Council’s mandate. As the Council did not feel the need to pursue any additional consideration regarding the judge’s conduct, the matter was closed.
