This complaint was addressed and closed previously in the year. However, the complainant attempted to refocus his complaint to increase the chance of an investigation. In his previous complaint, he alleged that a judge had failed to enforce his decision in a timely manner and brought the appearance of administration of justice into disrepute. The complainant requested that the Council compel the judge to issue an order to stop garnishing his salary for child support payments.

The Council explained that when the correctness of a judge’s decision is questioned, the issue should be raised before the courts, usually by means of an appeal as the Council cannot change or rescind an order, and closed the matter. When the complainant resubmitted documentation, he reworked the content of the complaint, but did not include additional information which meant that the issues he raised remained the same and still did not pertain to the Council’s mandate. The matter was closed.
