A complainant recommended that a judge’s conduct be reviewed following a ceremony where comments about the complainant were considered to be disparaging and libelous. The complainant was attending a Call to the Bar Ceremony where he was described by the judge as being “part fishing admiral and part pirate”.

The judge provided his comments about the complaint to explain that he felt sorry and disappointed and that his comments were made in humor to express his personal support and respect.

In review of the entirety of the remarks, the Council concluded that the comments were not intended to be disparaging and libelous. As it was clear that the comments were made with the intention of high regard, the matter was closed.
