A Municipal District Council, which the complainants belong to, had recently purchased a plot of land. The judge had repeatedly stated that the decision to buy the land was inappropriate and too expensive. The complainants explained that they felt the comments were unsupported by evidence, and unnecessary to disclose during the case. As the Municipal District Council was not a party to the case, the complainants (who are members of this council) were not invited to make submissions. The complainants felt it was wrong for a judge to make these statements, and it had the potential to harm the reputation of the Municipal District Council.

The Council concluded that this complaint was directed towards the judicial decision-making, as opposed to the judicial conduct of the judge, which falls outside the Council’s mandate. The matter was closed.
