In a family court matter regarding spousal support and matrimonial property separation, the judge was accused of ridiculing and verbally abusing the complainant as well as being biased.

The Council determined, by listening to the audio file of the hearing, that the judge had to maintain authority throughout the hearing and had to speak loudly due to the complainant’s auditory impairment, but did so in a respectful manner. It was also apparent from the audio file that the complainant was non-responsive and did not take the matter seriously throughout the case. As for the accusation of bias, the complainant was advised that a judge must always remain impartial during a hearing, and did so.

The Council determined that the source of this complaint was based on the outcome of the case, and not because of the conduct of the judge involved. The matter was closed.
