The Council received a complaint regarding a judge where the complainant alleged that the judge failed to meet the level of understanding of the English language required to provide a fair hearing in summary judgment proceedings in 2012.

The Council determined, by reviewing the case and a detailed 20-page judgement which only included 7 mistakes, that these mistakes did not indicate a failure to understand the English language. Additionally, the Council is not mandated to appeal a case based on the expression of dissatisfaction with the judge’s legal decisions. The complainant appealed the decision, and the Supreme Court of Canada denied the application. The matter was closed.
