In this correspondence to Council, the complainant alleged that two judges had an affair while they were both practising law in the same firm, and that once one of the judges was appointed, he then appointed the other judge. The complainant felt that the past conduct of both make them palpably unfit and is a scandal that has left an enduring stain on the judges’ capacity and fitness for the bench.

The Council concluded that the complaint did not warrant consideration as it did not involve judicial conduct and therefore does not relate to its mandate. The matter was closed.
